splashy is a service where signed-in users can post short thoughts and view them through an anonymous timeline and random display.
Terms of Use
Basic conditions for using splashy.
This page describes the basic operating policy for the service. The content may be reviewed as needed.
Account
Users are responsible for managing their passkeys and recovery codes. Except in cases of our willful misconduct or gross negligence, we are not liable for damages caused by account mismanagement, third-party use, or unauthorized use. Access may be suspended if unauthorized use is suspected.
Agreement to terms
Users must review and agree to these terms before using the service. If agreement to the Terms of Use is required during account registration, only users who agree may register. By using the service, users are deemed to have agreed to these terms.
Posts
Usernames are not displayed publicly, but users remain responsible for the content they post. Posts that violate laws, public order, third-party rights, personal information, confidential information, or harmful content are prohibited. Except in cases of our willful misconduct or gross negligence, we are not liable for damages incurred by users or third parties due to posted content.
Prohibited conduct
Unauthorized access, excessive load, attacks or harassment against others, impersonation, infringement of third-party rights or privacy, providing benefits to antisocial forces, political, election, religious, or similar activities, and actions that interfere with service operation are prohibited. If a user violates these terms or prohibited conduct and causes damage to us, we may seek an injunction and damages from that user.
Handling of personal information
For service provision, maintenance, investigation, and abuse prevention, we may review or obtain information entered or posted by users, access information, device information, and other information related to use of the service. Personal information is handled appropriately in accordance with the Act on the Protection of Personal Information and other applicable laws. Except in cases of our willful misconduct or gross negligence, we are not liable for damages caused by a user posting personal information, confidential information, or other information unsuitable for public disclosure on the service.
Ownership of rights
Intellectual property rights and all other rights related to the service belong to us or the rightful owners. Users represent that they have the necessary rights to the content they post or may lawfully use it.
Disclaimer
The service is provided as is. We do not guarantee continuity, accuracy, security, usefulness, fitness for a particular purpose, or absence of defects. Except in cases of our willful misconduct or gross negligence, we are not liable for damages incurred by users or third parties due to use or inability to use the service, posted content, disputes between users or with third parties, or posting, viewing, leakage, loss, or other handling of personal information or other information.
Service suspension
We may suspend, interrupt, change, or terminate all or part of the service for system maintenance, incident response, security needs, natural disasters, external service outages, or other unavoidable reasons. Except in cases of our willful misconduct or gross negligence, we are not liable for damages caused to users by such actions.
Changes
We may change these terms if the change conforms to users' general interests or is reasonable in light of the need for the change, the appropriateness of the changed content, and other circumstances. Important changes will be announced in a visible way on the service, and users who use the service after the announcement are deemed to have agreed to the changed terms.
Governing law and jurisdiction
These terms are governed by and interpreted under the laws of Japan. If a dispute arises in relation to these terms or the service, the Japanese court with jurisdiction over our location will be the exclusive court of first instance.
